Painting sits in an odd spot in the health and safety system: a trade with genuinely fatal risks — falls, lead, solvents — that's often treated as low-risk until something goes wrong. The Health and Safety at Work Amendment Bill (passed 1 July 2026, in force 1 April 2027) sharpens that picture: manage the critical risks properly, drop the paperwork theatre.
What changes for painters and decorators
Critical risks become the core duty (1–19 workers). The painter's critical list:
- Falls from height — ladders, scaffolds, roof edges on exterior work
- Lead paint — presume it in pre-1980 buildings; dry-sanding is the killer habit
- Hazardous substances — solvents, thinners, two-pack coatings (occupational asthma)
- Asbestos — pre-2000 cladding, soffits and textured ceilings
- UV exposure — an occupational disease risk on every exterior job

Height rules become proportionate. The risk-based hierarchy of controls (from April 2027) is arguably worth more to painters than any other trade: exterior repaint quotes routinely carry a scaffold line that exceeds the painting itself. ACOPs become a safe harbour. Follow the published code for a risk and you're deemed compliant for it. Adopt each one as it lands.
What doesn't change
Hazardous substances regulations, asbestos regulations, notifiable event reporting, and your PCBU duty of care all continue. And the current Act applies in full until 1 April 2027 — quote and work to today's rules until then.
The quoting angle
A weatherboard touch-up on one elevation currently inherits the same access logic as a full repaint. From April 2027, the painter who can show a documented risk assessment — task, duration, height, surface, controls — prices small exterior jobs competitors can't.
