What are the health and safety law changes for NZ painters?

Will painters still need scaffolding for two-storey exterior work?

For full exterior repaints, most likely yes — long-duration work at two-storey height sits at the serious end of the risk hierarchy, where scaffold or elevated work platforms remain the expected controls. The change bites on the small end: touch-ups, single elevations, short-duration fascia and soffit work may become defensible from ladders, podium steps or EWPs where a documented risk assessment supports it. Is lead paint a critical risk under the new law?

Do solvent and spray-coating rules change?

Solvents, two-pack coatings and spray application remain on the critical-risk side of the ledger through fire risk, acute exposure and long-term occupational disease — isocyanates in two-pack products are a leading cause of occupational asthma. Keep safety data sheets accessible, ventilate, use supplied-air or appropriate respiratory protection for spraying, and store flammables correctly. What changes is proportionality elsewhere: a small decorating firm won't be expected to maintain formal policies for trivial hazards alongside this.

What should a small painting business do before April 2027?

Build a one-page critical risk register — heights, lead, solvents, asbestos, UV — and go through it with everyone on the brush crew; a register nobody has read protects nobody. Keep first aid, emergency plans and facilities in place, since welfare duties continue. Watch for the working-at-height Approved Code of Practice: following it will be deemed compliance, and height is where painting's fatal risk lives. What doesn't change

Hazardous substances regulations, asbestos regulations, notifiable event reporting, and your PCBU duty of care all continue. And the current Act applies in full until 1 April 2027 — quote and work to today's rules until then.
